Terms of Use - NexClub

These Terms of Use ("Terms") govern your access to and use of the NexClub mobile application and website ("NexClub", "the app", "we", "our", or "us").

By accessing or using NexClub, you agree to be bound by these Terms.

1. Description of the Service

NexClub is a platform that enables users to discover club events and allows clubs and event organizers to publish, manage, and promote event information. The service is provided on an "as is" and "as available" basis.

We reserve the right to modify, suspend, or discontinue any part of the service at any time without prior notice.

2. User Access

Regular users may browse publicly available content without creating an account. Clubs and event organizers may receive access to club accounts that allow them to create, manage, and promote events.

Account holders are responsible for maintaining the accuracy of all information published through their account.

3. Club and Event Content

Clubs and event organizers are solely responsible for the content they publish on NexClub. By submitting content to the platform, the account holder confirms that the information is accurate, they have the right to publish it, it does not violate applicable laws, and it does not infringe third-party rights.

NexClub may remove content that violates these Terms or applicable laws.

4. Event Information Disclaimer

NexClub provides information supplied by clubs and event organizers. We do not guarantee accuracy, availability, schedules, pricing, capacity, or quality of events. Events may be modified, postponed, canceled, or changed by organizers without notice.

Attendance at any event is at the user's own discretion and risk.

5. Paid Features

Certain features of the platform may be offered as paid digital services, including promotional event placements and other premium features. Payments may be processed through Apple In-App Purchases or other authorized payment providers where available.

NexClub does not store payment card information. Except where required by applicable law, payments are non-refundable once the purchased digital service has been delivered or activated.

6. Prohibited Conduct

Users agree not to violate applicable laws, upload misleading or unlawful content, attempt unauthorized access, interfere with platform security, distribute malicious software, or use the service in a manner that harms NexClub, users, clubs, or third parties.

7. Account Suspension and Termination

We reserve the right to suspend, restrict, or terminate any account if we reasonably believe these Terms have been violated, the account is being used unlawfully, the account poses a security risk, false information has been provided, or the platform is being abused.

In serious situations, suspension or termination may occur immediately and without prior notice.

Users may request account deletion by contacting support@nexclubapp.com.

8. Intellectual Property

The NexClub application, branding, logos, design, software, and related materials are protected by applicable intellectual property laws. Users may not copy, distribute, modify, reverse engineer, or commercially exploit any part of the platform without prior written permission.

Content uploaded by clubs remains the property of its respective owner. By publishing content on NexClub, the account holder grants NexClub a non-exclusive license to display and distribute such content within the platform for the purpose of operating the service.

9. Limitation of Liability

To the maximum extent permitted by law, NexClub shall not be liable for indirect damages, consequential damages, loss of profits, loss of revenue, loss of business opportunities, event-related disputes, or cancellations or changes made by event organizers.

The total liability of NexClub shall not exceed the amount paid by the user for the specific service giving rise to the claim.

10. Privacy

Use of NexClub is also governed by the Privacy Policy, which explains how information is collected, processed, stored, and protected.

11. Changes to the Terms

We may update these Terms from time to time. Updated versions will be published on this page. Continued use of the platform after changes become effective constitutes acceptance of the updated Terms.

12. Governing Law

These Terms shall be governed by and interpreted in accordance with the laws of the Slovak Republic. Any disputes arising from these Terms shall be subject to the jurisdiction of the competent courts of the Slovak Republic.
